These Terms of Service ("Terms") govern your use of the bloompad.ai platform, operated by Atlas Intelligence LLC ("bloompad.ai," "we," "us," or "our"). By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, you may not use the platform.

Please read these Terms carefully. They contain important information about your rights, obligations, and the limitations of our liability. These Terms, together with our Privacy Policy, form the complete agreement between you and Atlas Intelligence LLC regarding your use of bloompad.ai.

1. Acceptance of Terms

By accessing or using bloompad.ai, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and agree to comply with these Terms and all applicable laws and regulations. If you are using the platform on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Description of Service

bloompad.ai is an AI-powered business automation platform that uses a multi-agent system to help small and mid-sized businesses manage operations. Our services include, but are not limited to:

Social media management and content creation across multiple platforms
Customer communication via email, SMS, and messaging platforms
Financial reporting and business intelligence dashboards
Appointment scheduling and calendar management
Online reputation monitoring and review management

The platform integrates with third-party services to deliver these capabilities. Service features and availability may change as we continue to develop the platform.

3. User Accounts

To use bloompad.ai, you must create an account and provide accurate, complete information. You are responsible for:

Maintaining the confidentiality of your account credentials.
All activity that occurs under your account.
Notifying us immediately if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

4. Acceptable Use

You agree not to use bloompad.ai to:

Engage in any illegal, fraudulent, or harmful activity.
Abuse, interfere with, or circumvent any third-party API or service accessed through the platform.
Misrepresent your identity, business, or affiliation with any person or entity.
Transmit malware, spam, or any content that violates the rights of others.
Attempt to reverse-engineer, decompile, or extract source code from the platform.

5. Social Media Publishing

By connecting your social media accounts (including Meta/Facebook, Instagram, and TikTok), you authorize bloompad.ai and its AI agents to create, schedule, and publish content on your behalf. You acknowledge that:

You retain full ownership of all content published through the platform.
bloompad.ai acts as your authorized agent when posting to your accounts.
You are ultimately responsible for all content published to your social media profiles, including content generated by AI agents.
You may review, edit, or revoke scheduled content at any time before publication.

6. Financial Data

When you connect accounting services such as QuickBooks, you acknowledge that:

bloompad.ai accesses your financial data in read-only mode for the purpose of generating reports and business insights.
We do not modify, create, or delete any financial records in your accounting systems.
You are solely responsible for the accuracy and completeness of your financial data.
Reports and insights generated by bloompad.ai are for informational purposes only and do not constitute financial, tax, or legal advice.

7. AI-Generated Content

bloompad.ai uses artificial intelligence to generate content, including social media posts, captions, replies, and business reports. You acknowledge that:

AI-generated content may contain errors, inaccuracies, or biases.
You are responsible for reviewing AI-generated content before it is published or acted upon.
bloompad.ai is not liable for any damages arising from the use of AI-generated content.
AI outputs do not represent the views or opinions of Atlas Intelligence LLC.

8. Third-Party Services

bloompad.ai integrates with third-party services including Meta, TikTok, Google, QuickBooks, Twilio, and Yelp. Your use of these integrations is subject to the respective terms and policies of each third-party provider, including but not limited to:

Intuit QuickBooks Terms of Service
Twilio Acceptable Use Policy

We are not responsible for the availability, accuracy, or conduct of any third-party service. Changes to third-party APIs or policies may affect the functionality of bloompad.ai, and we will make reasonable efforts to adapt to such changes in a timely manner.

9. Intellectual Property

The bloompad.ai platform, including its software, design, AI models, branding, and documentation, is the intellectual property of Atlas Intelligence LLC and is protected by applicable laws. You retain full ownership of your data, content, and materials uploaded to or created through the platform. You grant us a limited, non-exclusive license to use your content solely to provide and improve our services.

10. Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

To the fullest extent permitted by law, Atlas Intelligence LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or business opportunities, arising from your use of bloompad.ai. This includes, without limitation, damages resulting from:

Interruptions or errors in service availability
Unauthorized access to your account or data
Actions taken by third-party services connected through the platform
AI-generated content that is inaccurate or inappropriate

Our total aggregate liability for any claim arising from these Terms or your use of the platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Atlas Intelligence LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate this agreement at any time. You may close your account through your account settings or by contacting us. We may suspend or terminate your access if you violate these Terms. Upon termination:

Your right to access the platform ceases immediately.
You may request an export of your data within 30 days of termination.
We will delete your data in accordance with our Privacy Policy, subject to any legal retention obligations.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law provisions. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Travis County, Texas.

14. Dispute Resolution

Before initiating any formal legal proceedings, you agree to first contact us at legal@bloompad.ai and attempt to resolve the dispute informally for at least thirty (30) days. If the dispute cannot be resolved informally, either party may pursue resolution through binding arbitration administered under the rules of the American Arbitration Association, conducted in Austin, Texas.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the effective date. Your continued use of bloompad.ai after such changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue your use of the platform.
